CLONCURRY SHIRE COUNCIL -MAJOR AMENDMENT TO THE CLONCURRY PLANNING SCHEME

Made under the Sustainable Planning Act 2009 and Sustainable Planning Regulation 2009

 

PURPOSE and GENERAL EFFECT:

Cloncurry Shire Council is proposing to amend the Cloncurry Shire Planning Scheme (Cloncurry Shire Plan 2003) 

Amended Planning Scheme to include:

 

Priority Infrastructure Plan

·     Introduction of a new Priority Infrastructure Plan -See Section 6.

o   This Priority Infrastructure Plan integrates land use and infrastructure planning to ensure that trunk infrastructure is provided in an efficient and orderly manner.

 

Planning Scheme Codes

·      Introduction of a new Landscaping Code - See Section 3.13.9.

·     Introduction of a new Public Utilities Code - See Section 3.13.8.

o   These amendments provide new assessment criteria for landscaping and public utilities works.

 

Planning Scheme Policies

·      Introduction of a reviewed  Operational Works and Services Planning Scheme Policy 2 - See Section 7.2.

o   This new PSP amends an existing policy and provides additional guidance for the assessment of operational works.

 

Minor Changes and Formatting

Inclusion of a series of minor changes and amendments as a consequence of the above major changes.

 

FURTHER DETAILS:

Amendments made to the Cloncurry Planning Scheme are available for Inspection and purchase through Council’s Office or website.  The amendments are made are provided in Word format and for ease of review, the amendments are made in grey text throughout the document.

 

SUBMISSIONS:

Written submissions about any aspect of the proposed Planning Scheme amendments may be made to the Cloncurry Shire by any person.  Submissions can be made during 29 February 2012 to x 20 April 2012


REQUIREMENTS FOR MAKING A PROPERLY MADE SUBMISSION ARE:

A submission that –

a)      is in writing and, unless the submission is made electronically under this Act, is signed by each person who made the submission; and

b)      is received during the consultation period.

c)      States the name and residential or business address of each person making the application.

d)      States the grounds of the submission and the facts and circumstances relied on in support of the grounds; and

e)      Is made to the local government (Cloncurry Shire Council)

GENERAL INFORMATION
A development approval is required to undertake a variety of proposals relating to the development of land or buildings. The Sustainable Planning Act 2009 (SPA), provides a system whereby a development may be approved through an integrated process based on a single application. SPA established a simple step-by-step process for making, assessing and deciding development applications in Queensland. This process is called the Integrated Development Assessment System (IDAS).
Development applications are required so that development proposals are considered in compliance with the Cloncurry Shire Council Town Planning Scheme and relevant legislation.
Development Approvals:
Once a development application with all supporting documents have been lodged, and all required fees have been paid, Council will endeavour to have an Acknowledgement Notice and/or Information Request to you within 10 business days.

PLANNING
Planning applications are assessed under the Sustainable Planning Act 2009:-
 
Applications for a Material Change of Use (MCU) Includes
·         the start of a new use of the premises; or
·         the re-establishment on the premises of a use that has been abandoned; or
·         a material increase in the intensity or scale of the use of the premises;
 
 
FORMS REQUIRED:
 
  
 
RECONFIGURATION
Application for the reconfiguring a lot includes
·         creating lots by subdividing another lot
·         amalgamating 2 or more lots
·         rearranging the boundaries of a lot by registering a plan of subdivision
·         dividing land into parts by agreement rendering different parts of a lot immediately available for separate disposition or separate occupation, other than by an agreement that is—
·           a lease for a term, including renewal options, not exceeding 10 years; or
·           an agreement for the exclusive use of part of the common property for a community titles scheme under the Body Corporate and Community Management Act 1997; or
·         creating an easement giving access to a lot from a constructed road.

OPERATIONAL WORKS
Application for operational works include
·         extracting gravel, rock, sand or soil from the place where it occurs naturally
·         conducting a forest practice
·         excavating or filling that materially affects premises or their use
·         placing an advertising device on premises
·         undertaking work in, on, over or under premises that materially affects premises or their use
·         clearing vegetation, including vegetation to which the Vegetation Management Act applies
·         undertaking operations of any kind and all things constructed or installed that allow taking
·         interfering with water, other than using a water truck to pump water, under the Water Act 2000
·         undertaking constructing or raising waterway barrier works
·         undertaking roadwork’s on a local government road.
 
FORMS REQUIRED:
All Integrated Development Assessment System (IDAS) and Plumbing or Drainage forms can be downloaded from the Queensland Government's Department of Infrastructure and Planning website.
BUILDING
Building work applications are assessed under the Sustainable Planning Act 2009, the Building Act 1975 and Building Regulation 2006:-

Building work includes
·         building, repairing, altering, underpinning (whether by vertical or lateral support), moving
·         demolishing a building or other structure
·         work regulated under the building assessment provisions, other than IDAS
·         excavating or filling—
o   that may adversely affect the stability of a
o   building or other structure, whether on the
o   land on which the building or other structure

FORMS REQUIRED:
 
 PLUMBING OR DRAINAGE WORKS
Plumbing or Drainage work applications are assessed under the Plumbing and Drainage Act 2002:-

Plumbing & drainage work includes
 
·         installing, changing, extending,
·         disconnecting,
·         taking away and maintaining plumbing & drainage.
 POOL SAFETY
Pool owners have until 30th November 2015 to comply with the pool safety laws, or earlier if they sell or lease their property before this time.  If selling, buying or leasing a property with a pool, a pool safety certificate must be obtained from a licenced pool safety inspector.
