Local Laws

Council has a number of local laws that apply across the Shire.

Proposal to Repeal and Replace Local Law No. 9

On 16 July 2024, Cloncurry Shire Council (“Council”) resolved to propose to repeal Local Law No. 9 (Cloncurry Aerodrome Management) and replace it with a new Local Law No. 9 (Aerodrome Management) 2024 (“the Proposed New Local Law”).

The purpose of the Proposed New Local Law is to regulate the use and operation of aerodromes controlled by Council, by:

• protecting the public against risk of injury and the community against damage;
• ensuring that activities at the aerodrome are undertaken in an orderly and safe manner and do not create a hazard to public health or a threat to property;
• controlling the public use of the aerodrome to the extent that the use is consistent with the rights, expectations and safety of the local community;
• protecting the obstacle limitation surfaces at the aerodrome and minimising hazards to aircraft; and
• providing for:
  • fees and charges for the right to use the aerodrome;
  • the enforcement powers of Council and any authorised persons of Council under the local law;
  • the imposition of penalties for breaches of the local law; and
  • liability arising out of use of the aerodrome.

Public Consultation

Council invites the public to provide written submissions on the Proposed New Local Law for the period commencing on Monday, 22nd July 2024 and ending on Friday, 16th August 2024 (“Consultation Period”).  Written submissions made by any person, either supporting or objecting to the Proposed New Local Law, must state:

1. The grounds of the submission; and
2. The facts and circumstances relied on in support of the grounds.

Written submissions may be provided to Council in writing during the Consultation Period and may be delivered to Council:

1. by email to council@cloncurry.qld.gov.au;
2. by post to PO Box 3, Cloncurry Qld 4824; or
3. by hand-delivery to Council’s Administration Office located at 38-46 Daintree Street, Cloncurry.

Written submissions may only be considered if they are received by Council before 5.00pm on Friday, 16th August 2024. Submissions received after this time and date may not be considered by Council.
